Deadly Force : What Rights You Have

Just before 7:30PM Wednesday, Wichita Falls Police say a homeowner shot and killed John Paul Morgan Jr., 30, Heidelberg, MS. They say he was breaking into a home in the 1300 block of Austin Street.

Investigators are working to determine if the shooting is justified. Standard procedure when a shooting happens is to investigate it as a Homicide, even when it appears to be in self-defense. 

WFPD Officer Timothy Johnson says Texas Law affords citizens the right to use deadly force in certain circumstances. "What the Law requires is that you have to be in some type of fear of bodily injury... If you have reason to believe that they are there to commit a crime against you or your family."

Johnson says an intruder does not necessarily have to be armed. "What it gets back to is a reasonable belief, what you believed at the time it was occurring.", he said.

Johnson says it all comes down to reasonable fear for your life. He also urges citizens to have a clear head about use of force. "I would advise people to use your common sense, because the consequence, you will have to live the rest of your life with."
