Man Charged With Murder Not Facing Death Penalty

The Montague County man charged with the death of his unborn child will not face the death penalty, if convicted.

Montague, Clay and Archer County District Attorney Jack Lee McGaughey said his office will not seek the death penalty in the case against Michael Lee Cunningham. Instead, McGaughey said his office will seek life in prison without parole if Cunningham is convicted. Cunningham is indicted with capital murder.

Montague County Deputies said Cunningham, 22, beat his pregnant girlfriend in February, causing the death of their child. You can review our continuing coverage of the case here.
