Two Texoma teens charged with Capital Murder will both be spared the death penalty.
Newschannel 6 has learned the Wichita County District Attorney will not seek the death penalty in the trial of Michael Shay Graves.
Graves, then 19 years old, was the lookout during an armed robbery and murder at Mo's Grocery on January 9, 2012.
The gunman, then 17 year old Clifton John Russell, went into the store on Old Iowa Park Road, waving a gun. He then shot and killed 66 year old Muhammad "Mo" Ahmad.
Police documents state Russell confessed to his family while they watched coverage of the crime on local news. A family member then notified police and Russell was arrested on January 10th. In a police affidavit, Russell confirmed Graves was his accomplice.
Graves turned himself in for an outstanding violation of probation warrant on January 11th. Police said Graves waived his Miranda rights and confessed that he went to Mo's Grocery with Russell on January 9, with the intent of robbing the store. Police said Graves admitted he stood at the door while Russell went in to rob the store.
Russell was never eligible for the death penalty because he was 17 at the time of the murder. If convicted, both men will face life in prison without the possibility of parole. No trial dates have been set.
