Judge Declare Mistrial in Lawton Swimming Pool Murder

A stunning development in the trial of a Lawton man accused of killing his wife and burying her body under a swimming pool.

The judge has declared a mistrial in the case of David Baird, who is charged with the murder of Claudine Marroquin back in September of 2013. 

The judge made his ruling after it was discovered that a search warrant was not properly executed in the case.

Although paperwork was signed on September 13th, it was not submitted to the court within the required 10 days.

The judge said a murder case was too important to  proceed without following the proper protocol.

Lawton prosecutors have not said whether they will retry the case.
