BURKBURNETT, TX (KAUZ) - A California man is behind bars and his daughter will be reunited with her mother following an arrest Friday morning in Burkburnett.
"We knew that they had Texas ties so we knew it was a possibility," Shasta County Deputy District Attorney, Patricia Van Ert said.
David Ernie Short, Jr. took his 7-year-old daughter from Oregon for a weekend trip out of state in May. But Shasta County officials said just days later Short called his child's mother and told her he was in northern California and was not bringing his daughter back to Oregon.
At the time of the incident, Van Ert said there were no custody orders. When her daughter was not returned, the mother filed custody papers with Shasta County and was granted custody. Short was notified and given 20 days to object.
"He didn't. Our investigator contacted him and told him he needed to return (the child) and he refused to do so," Van Ert said.
A felony warrant was issued out of Shasta County last week.
"My office was able to effect the arrest of a felon out of California for child abduction," Wichita County Constable, Precinct 2, Tom Black said.
Constable Black and his deputy said Short had been on their radar for months.
"We had child support papers for him," Black said.
They were able to make contact with him in Burkburnett to serve him those civil papers. Black said Short's daughter was there at the time.
"I met with and talked to his young daughter. She appeared to be in good health and thriving. She was in no immediate danger," Black said.
When Constable Black received word of Short's felony warrant out of California he passed the information to the Burkburnett Police Department.
Officers went to a home in the 600 block of Akers Street to arrest Short.
"He was taken into custody without incident. The child was located inside the residence safe and we took protective custody of her and called in child protective services and they helped us locate somebody that the child could stay with temporarily until her mother can get here," Detective Jonny Zellner said.
Short was taken to the Wichita County Jail charged with Deprived Rights on Custody/Visitation and Abducted Child.
