WICHITA FALLS, TX (KAUZ) - Willie Maurice Hervey, Jr. took the stand in day five of his own murder trial.
Hervey is accused of shooting Mark Austin Hawkins in 2014 during a drug deal.
Monday morning Hervey said the shooting was an accident and he did not know he shot Hawkins at the time. He added that he did not rob Hawkins and intended to pay Hawkins for the marijuana.
Hervey said he went to a friend's home immediately after the shooting and when he uncocked the gun a shell came out.
He said the blood on his jeans, which was presented in court by the prosecution last week, was not from murdering Hawkins.
Hervey instead said the blood was from his nose and that he had wiped it on his jeans that day.
Hervey adds a day never goes by without thinking about that day and the families involved.
The trial continues in the Wichita County Courthouse Tuesday at 8:30 a.m. with closing arguments inside the 89th District Court.
The defense and prosecution will be given 90 minutes a piece.
Jury deliberations for a guilty/not-guilty plea are expected to follow.
