WICHITA FALLS, Texas (TNN) - Monica Horton, from the Better Business Bureau of North Central Texas, joined Jake in studio to talk about recent law changes that will affect everyone from the consumer to the contractors.
The BBB wants to notify roofers, contractors, dent-repair companies and even consumers in Texas of recent changes to laws that govern the industry.
These laws will have a particularly profound effect on roofers and dent-repair companies.
According to the Texas Department of Insurance, a new Texas law will now clarify that it is illegal for a contractor, roofer or dent-repair company to waive an insurance deductible or promise a rebate for all or part of the deductible.
House Bill #2102 law went into effect Sept. 1, 2019.
Violators could receive, “up to a $2,000 fine,” and, “180 days in jail.”
Prior to this change, some companies offered, “deductible assistance programs,” to gain a competitive advantage among competitors and customers.
Also according to the new law, insurers that issue property insurance with replacement cost coverage may also refuse to pay a claim until they receive. “reasonable proof of payment.” of the deductible by policyholder.
The BBB encourages consumers and professional contractors to seek additional information and clarification from the Texas Department of Insurance before they run into an issue, not after.
